Terms of Service

Welcome to MyContentHarbor, a service of Alpine Economics LLC (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of the MyContentHarbor website, cloud services, APIs, subdomains, related software, applications, AI-generated content engines, and other services provided by us (collectively, the “Service”).
Read these Terms carefully: By creating an account, purchasing a subscription or credit, accessing the Service, or using any part of MyContentHarbor, you agree to be bound by these Terms, along with our Privacy Policy, all payment-related terms, Acceptable Use Policy, and any other rules posted in the Service or otherwise provided to you. If you do not agree, you must not use the Service.
1. Who May Use the Service
- Eligibility: You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is older. By using the Service, you represent you meet these requirements, and that you are not barred from using the Service under any applicable law.
- Business Users: If you access or use the Service on behalf of a business, organization, or other legal entity (collectively, “Entity”), you represent and warrant that you are duly authorized to bind such Entity to these Terms. The word “you” in these Terms refers to both you personally and the Entity.
- Jurisdiction: You may not access the Service if you are located in a jurisdiction subject to sanctions, embargoes, or export controls of the United States, EU, or other relevant authorities (see Section 21).
2. Account Registration and Security
- You agree to provide accurate, complete, and current registration details (including a valid, frequently checked email address) and to update this information as necessary.
- You are solely responsible for keeping your password and authentication credentials confidential, and for all actions taken under your account.
- Accounts registered through automated means or false identities are void and subject to immediate suspension and deletion.
- If you become aware of any unauthorized access or security incident affecting your account, you agree to notify us immediately at support@mycontentharbor.com.
3. Services Provided, Features, and Changes
- Description: MyContentHarbor provides cloud-based tools for generating, managing, exporting, and organizing AI-created marketing content (including, but not limited to, blog articles), via direct interaction, programmable APIs, scheduled/prompted automation, and export/download utilities. The Service makes use of hosted AI models (including those provided via API by OpenAI), integrated payment processors (Stripe), notification/email services (Resend), usage analytics (Cloudflare/dataset), and other infrastructure providers as reasonably required.
- Availability: We strive to operate the Service with high reliability, but make no guarantee of uptime, uninterrupted availability, or continued access to any particular feature. Features may be changed, suspended, or discontinued without notice, including integrations with third-party services.
- BETA & Experimental Features: Any indicated “beta” or experimental functionality may be unstable, less reliable, or subject to removal, and is provided strictly “as is”.
- Right to Modify or Discontinue: We reserve the right to modify, improve, update, restrict, or discontinue the Service or any part thereof (including access for free trial or paid users) at any time for any reason, including changes in AI third party terms or extrinsic technical, legal, regulatory, or business circumstances.
4. Acceptable Use Policy
- Lawful Use: You agree to use the Service only for lawful purposes and in compliance with all applicable laws, regulations, and these Terms.

Prohibited Conduct: You may not use the Service to:
- Violate, or encourage violation of, any law or regulation, including IP, copyright, anti-spam, privacy, and export laws;
- Upload, generate, export, or transmit content that is defamatory, obscene, abusive, threatening, harassing, deceptive, misleading, libelous, fraudulent, invasive of privacy, violent, hateful, discriminatory, or otherwise objectionable;
- Infringe or misappropriate any intellectual property or proprietary right of any person or entity;
- Post or distribute unlawful, harmful, sensitive, or regulated data or content, including but not limited to personal health information (PHI), regulated financial data, personally identifiable information not provided by the user, special categories of EU personal data, or material subject to international sanctions;
- Attempt to circumvent, reverse-engineer, hack, compromise, probe, or disrupt the Service, its security or authentication systems, or those operated by any third party integrated in the Service (OpenAI, Stripe, Resend, Cloudflare, etc.);
- Perform automated scraping, data harvesting, or model extraction to exfiltrate AI training data;
- Attempt to bypass generation limits, credit usage, or other paywall features;
- Impersonate any person or entity, or falsely state or misrepresent your affiliation;
- Export, use, or resell AI-generated content for any illegal, malicious, fraudulent, or abusive purpose;
- Use the Service to create or disseminate harmful, false, misleading, life-or-safety-impacting, or regulated information (including but not limited to medical, financial, or legal advice, unless properly licensed and reviewed);
- Use the Service in conflict with any Acceptable Use Policy of third parties (including OpenAI and Stripe).
- No Automated Mass Publication: Automated (non-human-reviewed) distribution or publication of AI-generated content at scale (for example, model output "spam" or unreviewed mass auto-blogging) is strictly prohibited and may result in immediate account suspension and reporting to relevant authorities.
- Enforcement: We may immediately suspend or terminate accounts for any suspected violation of these policies, and may cooperate with law enforcement and providers (e.g., OpenAI, Stripe) as required by law or contract.
5. User Content, AI Output, and Intellectual Property
- User Content: “User Content” means data, information, prompts, text, images, files, topics, metadata, and any other content that you submit, upload, input, or generate via the Service. You remain responsible for your User Content.

Generated (AI) Content: The Service produces content (“AI Output Content”) by leveraging third-party AI services (including but not limited to OpenAI). While you retain any rights you may possess in the output (subject to Section 5.iii below), you acknowledge and agree:
- AI Output Content is computer-generated without human editorial review and may be inaccurate, incomplete, generic, offensive, nonsensical, or otherwise problematic;
- Identical or similar outputs may be generated for other users of the Service or of the model provider (OpenAI, etc.), either now or in the future;
- MYCONTENTHARBOR MAKES NO REPRESENTATION or warranty concerning the originality, non-infringement, legal usability, factual accuracy, fitness for purpose, or merchantability of AI Output Content.

Third-Party Model Requirements:
- Your use of AI Output Content must comply with OpenAI’s Terms of Use, including but not limited to further restrictions on medical, financial, legal, life/safety-critical information, or use in violating or restricted jurisdictions.
- Output may not be used for (or in conjunction with) breaking model or API safeguards, bypassing filters, model extraction or “jailbreaking,” or for prohibited commercial or high-risk activities as determined by OpenAI or other upstream providers.

Your Responsibilities:
- You are solely responsible for reviewing, vetting, editing, fact-checking, and, if appropriate, securing copyright clearance or legal review for all AI Output Content you export, distribute, publish, or use, whether for personal or commercial use;
- You must comply with all applicable laws, and must not violate or infringe upon intellectual property or other rights of any third party;
- You agree to indemnify and hold harmless MyContentHarbor and Alpine Economics LLC for any claim, cost, loss, or liability resulting from your use or publication of AI Output Content (see Section 13).
- Service Content and IP: Except for your User Content and AI Output Content as described above, all materials, code, designs, trade dress, methodology, and marks displayed on or by the Service (“Service Content”) are the exclusive property of Alpine Economics LLC or its licensors. You may not copy, reverse engineer, modify, distribute, or otherwise infringe upon these rights.
6. Subscription Plans, Payment, Free Trials, and Refunds
- Free Starter Access: New users may utilize a limited free-tier for trial (“Free Tier”), granting a defined number of free content generations, subject to change or discontinuance at any time and for any or no reason.
- Paid Subscriptions: Access to enhanced Service features requires purchase of a subscription (e.g., “Professional” or “Enterprise”) or the purchase of additional usage credits via integrated payment processors (Stripe). All prices, features, and allowed usage volumes are posted at /payments/pricing and in your user dashboard; plans and pricing are subject to change with notice to existing active subscribers.

Billing & Payment:
- All payments are processed by Stripe. You agree to provide accurate billing and payment information and to update payment methods as necessary to prevent service interruption.
- Subscription plans are billed in advance on a recurring basis (monthly, annual, or as offered), with automatic renewal unless cancelled prior to the renewal date. You authorize Stripe and us to continue charging your payment method until cancellation.
- You are responsible for all fees, taxes, duties, or government charges associated with your use of the Service.
- Free Trials (if offered): Some subscription plans may include a free trial; if you do not cancel before trial ends, your payment method will be charged automatically and your plan will continue as described. You may only receive one free trial per account or per customer/company (determined at our sole discretion).

Refunds & Cancellations:
- You may cancel a subscription at any time. You will retain access until the end of your paid period; no refunds for unused partial months are provided, except where required by law.
- If you are not satisfied, you may request a refund within 30 days of initial purchase by contacting support; refunds are granted in our sole discretion, and are not available for abuse, excessive usage, or after substantial service consumption (use of >1/3 of the plan’s content limits may be deemed consumption).
- Subscription Plan Evolution, Credits & Quotas: We reserve the right to modify plan features, quotas, usage limits, or discontinue support for legacy plans. Credits, posts, or quotas not used in the applicable period (e.g., month) do not roll over unless explicitly stated.
- Reselling: Accounts may not be resold, shared outside your organization (except for explicitly enabled multi-user plans), or used as a bulk content generator for third parties except by prior written agreement.
7. Third-Party Services, Integrations, and APIs
- Third-Party Processors and Providers: MyContentHarbor relies on externally-operated providers (including but not limited to: OpenAI for AI generation, Stripe for payments, Resend for transactional emails, Cloudflare for hosting, DNS, and D1 database, and various email, analytics, and error reporting services).

No Control or Liability: We do not control and are not responsible or liable for the acts, omissions, availability, reliability, output, terms, or data handling of any Third-Party Service. Without limiting the foregoing, you acknowledge that:
- OpenAI may change their models’ features, outputs, response times, filtering, availability, or pricing, or moderate your prompts and outputs, with or without notice;
- Stripe is the merchant of record for payments; payment data is processed, stored, and managed by Stripe according to its own privacy policy and services agreement;
- Your use of APIs (including for integrations, webhooks) is subject to applicable rate limits, API keys, and third-party restrictions.
- Indemnification: You agree to indemnify and hold harmless MyContentHarbor for any claims, actions, fines, or liabilities arising from your usage or any breach of integration, API, or third-party service terms.
8. AI-Generated Content – Special Notices, Risks, and Disclaimers

AI Output Limitations:
- All content produced by our Service (including but not limited to blog posts, outlines, code, drafts, summaries, or SEO text) is machine-generated, subject to inaccuracy, “hallucination”, bias, and lacking context sensitivity or world knowledge.
- You acknowledge that AI Output Content might inadvertently reproduce, in whole or in part, third-party content or produce information that is inaccurate, outdated, or not fit for your intended purpose.
- You must not rely on AI-generated content for legal, medical, life-or-safety, or critical business decisions without additional human review, expert analysis, and fact-checking.
- AI Output Content is provided on an “AS IS, AS AVAILABLE” basis without any representations, warranties, or guarantees of originality, accuracy, legality, or safety.
- AI content should not be used to impersonate, pass off as human speech without disclosure, or to engage in plagiarism or other deceptive practices.

Output Risks:
- Generated content may contain offensive, inappropriate, harmful, or inaccurate material. We take reasonable steps (via model filters and prompts) to limit such content but cannot guarantee its absence.
- You release us from any liability or responsibility for the unintended propagation of third-party content, personally identifiable information (PII), or output that results in reputational or legal harm. Use at your own risk. You agree to promptly report and not intentionally distribute any such content if discovered.
9. Feedback, Suggestions, and User Contributions
- By submitting feedback, suggestions, bug reports, or ideas about the Service or its operation, you grant Alpine Economics LLC and its affiliates the unrestricted right to use, implement, distribute, modify, and commercialize such input in any way, without compensation or obligation.
10. Data Security, Privacy, and Use of Information
- Your use of the Service is subject to our Privacy Policy, which describes what data we collect, how it is used, and your rights or choices.
- We use industry-standard methods for securing user accounts, passwords (strong salted hash), stored content, analytics, and audit logs (see Privacy Policy for more).
- All content may be logged, monitored, or reviewed as needed to maintain and improve service quality, security, or to comply with applicable law.
- You consent to the transmission, storage, processing, and (where required) backup/replication of your data in the United States and via operational third-party providers (see Section 7 and the Privacy Policy).
- Please see the Privacy Policy for further information on data retention, export, deletion, and your rights under CCPA, GDPR, and other relevant regulations.
11. Service Access, API Keys, Webhooks, and Automation
- API Access: If applicable, access to APIs/Webhooks may only be used as expressly permitted, is subject to usage quotas or pricing plans, and requires you to keep keys confidential and not share with third parties. Automated API access or integration with automation tools (Zapier, Make, etc.) must comply with all other Acceptable Use restrictions.
- Rate Limits: Excessive usage, attempts to bypass rate limits, or violation of API-related policies will result in rate limiting, suspension, or ban at our discretion, and may be reported to upstream API providers.
- Webhooks: If applicable, you are responsible for the security and reliability of any configured webhook endpoints and for any actions triggered thereby.
12. Termination, Suspension, and Account Deletion
- Termination by You: You may terminate your use at any time by closing your account or ceasing to use the Service. To delete your account and associated content, contact us as described in the Privacy Policy; we may verify your identity before completing deletion.
- Suspension/Termination by Us: We may suspend or terminate your account or access to any Service feature, at our discretion or as required by law, policy, third-party provider, or if we believe you have violated these Terms (including failure to pay) or present risk to us, the Service, or other users.
- Effect of Termination: Upon termination (whether by you or us), your right to use the Service ceases immediately; sections concerning liability, data retention, AI output, payments due, IP rights, disclaimers, indemnity, and governing law survive termination.
- Account Inactivity: Accounts inactive for more than one year may be deleted after reasonable notice.
- Data Retention: We may (but are not obliged to) retain account and content data for up to 90 days after final termination for audit, legal, compliance, or technical backup purposes, unless longer retention is required by law.
13. Disclaimers and Limitation of Liability
- Service Provided "AS IS": THE SERVICE AND ALL OUTPUT, AI-GENERATED CONTENT, FEATURES, API INTEGRATIONS, AND ANY DATA OR MATERIALS PROVIDED BY OR THROUGH THE SERVICE ARE OFFERED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND RELIABILITY.
- No Guarantee of Uptime, Performance, or Accuracy: We do not guarantee that the Service, API, or AI-generated content will always be available, accurate, timely, error-free, virus-free, or meet your expectations or requirements.
- Third-Party Risks: Outputs may be changed, restricted, filtered, censored, or lost due to OpenAI or other provider actions beyond Our control. Payment processing, crediting and invoice fulfillment are the sole responsibility of Stripe or respective provider. Email delivery may be delayed or fail due to external factors.
- AI Output Risks: All generated content may be inaccurate, misleading, incomplete, non-unique, or legally problematic. You alone are responsible for all final review, editing, and usage decisions.

Maximum Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYCONTENTHARBOR, ALPINE ECONOMICS LLC, ITS OWNERS, EMPLOYEES, AFFILIATES, SUPPLIERS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR MULTIPLE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE, AI OUTPUT, OR THESE TERMS, EVEN IF FORESEEABLE OR ADVISED OF THE POSSIBILITY.
- IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED (A) THE AMOUNTS PAID TO US BY YOU IN THE 12 MONTHS PRIOR TO THE EVENT, OR (B) USD $100, WHICHEVER IS LESS.
- Some jurisdictions do not allow the exclusion of damages or limitation of liability. If so, our liability will be the minimum permitted by law.
14. Indemnification and Hold Harmless

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless MyContentHarbor, Alpine Economics LLC, its affiliates, officers, directors, employees, partners, successors, and assigns from and against any and all third-party claims, damages, liabilities, costs, or expenses (including legal, expert, and accounting fees) arising from or relating to:
- Your use or misuse of the Service, AI Output Content, or integrations;
- Your User Content;
- Your violation of any law or any of these Terms;
- Alleged or actual infringement of any third-party intellectual property or other rights;
- Any act or omission of a third party using your credentials, account, or site API key (whether authorized or not).
15. Export Controls and Sanctions

The Service is operated from the United States and is subject to U.S. export control laws and regulations. You represent and warrant that you are not:
- Located in, under the control of, or a resident of any country to which export or re-export is prohibited by the U.S. or other applicable law (including, but not limited to, Cuba, Iran, North Korea, Syria, Crimea, Russia, Belarus); or
- On any list of U.S. prohibited or restricted parties (such as the Specially Designated Nationals List, Denied Persons List, or Entity List); or
- Otherwise prohibited from receiving U.S. products, services, or software.
- You may not use, export, or re-export the Service or any part thereof in violation of any applicable law, regulation, or export control.
16. Changes to Terms
- We reserve the right to modify or update these Terms at any time, in our sole discretion. We will provide notice (via website posting and/or email, at our option) for material changes. The effective date will appear at the top of these Terms.
- By continuing to access or use the Service after changes become effective, you agree to the revised Terms. If you do not agree to the changes, you must discontinue use and may request account deletion.
- Past Terms may be made available upon request.
17. Governing Law and Dispute Resolution
- These Terms, and all matters relating to your use of the Service, will be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of laws principles.
- Exclusive Jurisdiction: Any disputes or actions arising from or relating to these Terms or the Service shall be resolved in the state and federal courts located in Salt Lake County, Utah, U.S.A. and you consent to personal jurisdiction and venue in such courts.
- Waiver of Jury Trial and Class Actions: EACH PARTY WAIVES THE RIGHT TO A TRIAL BY JURY. All claims must be brought individually, and not as a class action, consolidated, or representative proceeding.
- This section shall be interpreted broadly and survive any termination of these Terms.
18. Additional Legal Provisions
- Entire Agreement: These Terms, together with the Privacy Policy and any posted guidelines, constitute the entire agreement between you and us with respect to MyContentHarbor and supersede all prior understandings or agreements.
- Severability: If any provision is found to be invalid or unenforceable, the remainder will remain in effect.
- No Waiver: A waiver of any right under these Terms shall not constitute a waiver of any other right or provision.
- No Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign or transfer our rights without restriction.
- Survival: Sections relating to content, IP, limitations, disclaimers, indemnity, privacy, governing law, dispute resolution, export controls, and all other provisions which by their nature should survive termination shall survive.
